Terms of Service
Effective 26 October 2026
These terms apply to the FairDraw Global beta application, also called FairDraw, operated by Brian Pereira in Malaysia. Contact poolprofairdraw@gmail.com about the service or these terms. By using FairDraw, you agree to these terms. If you do not agree, do not create or use an account or enter events through the platform.
1. What FairDraw provides
FairDraw helps people discover and administer cue-sports tournaments, maintain player profiles, register entries, create draws and record results. The beta may contain errors, change or become temporarily unavailable. The simulator is for practice; its browser-only data is not a saved tournament. Planned features are not promises of availability.
2. Accounts and eligibility
Provide accurate account and player information, use an account you control, and keep access secure. Do not impersonate someone or upload a photo without the right to use it. You must be legally able to use the service and agree to these terms. Where a minor may lawfully participate, required parent or guardian permission and event or venue age rules must be met. Report suspected unauthorised access to us.
3. Organiser responsibilities
Organisers are responsible for their events, including venue permission, lawful operation, eligibility, playing rules, schedules, entry and buyback conditions, prize commitments, cancellations and disputes. Clearly disclose the full required price and any food or drink package before registration. Obtain permission to add another person’s details and use private player data only for the event purposes explained in the Privacy Policy.
4. Player responsibilities and rules
Review event details before entering and follow the published rules, venue requirements and umpire decisions. The selected playing ruleset is separate from FairDraw’s draw-administration rules. Buybacks, late entries and available places depend on event state and applicable rules; they are not guaranteed. Report an incorrect entry or result promptly to the organiser.
5. Payments, packages, prizes and refunds
The current beta does not collect online payments, hold prize funds or automatically issue refunds. Pay the named organiser or venue directly and confirm payment and cancellation terms before paying. Registration or package acknowledgement is not proof of payment, redemption or prize payment. Budget calculations, expected attendance and prize suggestions are estimates, not guarantees.
Organisers and venues remain responsible for money collected, services promised, prizes, cancellations and refunds, subject to applicable law. Nothing removes a consumer right or a responsibility FairDraw itself has under law.
6. Fair use
Do not cheat, manipulate results, harass others, publish unlawful material, infringe rights, misuse contact details, attempt unauthorised access, overload the service or bypass permissions. Use FairDraw only for lawful tournaments and related participation. These terms do not authorise betting, unlawful gambling or activity prohibited at the event location.
7. Content and privacy
You retain rights in submitted content and give FairDraw the limited permission needed to store, display and process it to provide the service, including published registration names and results. You must have the right to submit it. Private photos and WhatsApp numbers have the restricted access described in our Privacy Policy, which also explains Google sign-in data, providers, retention and choices.
8. Draws and corrections
Automated draws and permission checks help apply the configured format; they do not certify organiser fairness, player identity, skill or eligibility, or every result. Eligible organisers and umpires administer results and permitted corrections. Relevant actions may remain in event history. Contact the organiser first about an event decision and FairDraw about a platform fault.
9. Suspension and ending use
We may restrict access where reasonably needed for misuse, security or a legal requirement. Where practical and appropriate, we will explain the reason and offer a way to raise concerns. You can stop using FairDraw and request deletion through our data-deletion instructions. Account deletion is reviewed separately from event records retained for a legitimate purpose.
10. Service limits and your rights
We aim to provide the service with reasonable care but do not promise uninterrupted or error-free beta operation. Keep copies of important event details and payment agreements. Any exclusion or limitation applies only as permitted by law; nothing excludes non-waivable consumer rights, liability that cannot lawfully be excluded, or remedies under applicable law.
11. Third-party services
Google sign-in, hosting, authentication and WhatsApp operate through providers with their own terms and policies. A link to a provider, organiser or venue does not guarantee its services. Disconnecting social login does not itself delete your FairDraw account or event history.
12. Changes, law and contact
We may update these terms as FairDraw develops, publish a new effective date, and give further notice where required. Changes do not retrospectively alter agreed event payments or remove accrued legal rights. Malaysian law governs these terms, subject to mandatory protections where you live. Email poolprofairdraw@gmail.com so we can try to resolve concerns; this does not limit other lawful remedies.
